NOW, THEREFORE, in consideration af the mutual covenants ~

and agreements between the parties and the consideration herein- '
after. stipulated to be paid fr~m second party to first party, t
it is hereby contracted and agreed by and between the parties
hereto as follows: ~ ~ "
. l. That said second party, its grantees, legal represen- '
tatives, successors and assigns (subject to the provisions of
Ite~ 5 hereof) shall have the full and unrestricted right to
drain the surface waters, regardless of source, from all of the
hereinabove described lands ac,med by second party. First party
agrees that it will not in any way restrict or limit said drain-
age of second party into its 3rainage system unless any such
restriction or limitation is necessary and is comir.on to all of
the landowners within the boundaries of first party or being
serviced by first party pursuant to contract or agreement.
2. First party shall not be liable or responsible for
any maintenance, upkeep or ekpense whatsoever in connection with
~ any canals, laterals, ditches and/or drains of any sort located
~ on said above descri~ed lands and owned by second party.
3. Second party shall be responsible for whatever
maintenance, upkeep and expense is required regarding the canals,
laterals, ditches and/or drains used by it f~r drainage of its
said lands into first party's drainage system.
4. The party of the secor.d part agrees for itself, its
successors, legal representatives and assigns, to pay annually
unto first party, on November 1 of each year, beginning November l,
1973, a sum of money as consideration calcuZated by multiplying
the total number of acres or the total number of subdivision lots
or combination thereof o~,med ~y second party times the sum of
One Dollar ($1.00). The first s~ch ar.nual payment by second 1
party-shall be prorated as of the date of this agreement
