of this agreement.
Should any annual sum due first party from second
party hereunder be not paid by April 1 of the next succeeding
year after said sum becomes due, as hereinabove provided, first ~

party shall be entitled to interest on said sum at the rate of `

18$ per annum for the f irst year, 10$ per annum for the second ,
~
year, and 8$ per annum thereafter until paid, an~ said sum and ~
the interest thereon shall constitute a lien upon all of second `
party's said lands inferior only to the lien of ad valorem taxes ~

legally levied and assessed against said lands; that if the ~
annual sum due first party from second party, plus accrued interest,

is not paid within 60 days after the same becames delinquent on ~
April 1, as hereinabove provided, first party shall have the
right to enforce the payr.ent of said sums through the foreclosure ~
of its said lien against the lands owned by second party, in ~
~
which event the pleadings,•process, proceedings, practice and ~
~
~
sale shall be the s~me as in an action for the enforcer.~ent and ~
~
foreclosure of a mortgage upon real property; that in the event ;
f

of a foreclosure of said lien, said party of the ~econd part, ~
;
~
for itself, its successors, legal representatives or assigns, ~
~
agrees to pay all and singular the costs, charges and expenses,
including reasonable attorney's fees and court costs incurred or
;
paid by said first party in said foreclosure. ~

5. This agreement shall be binding upon all of the herein- s
