to the following described property, situate, lying and being in
St. Lucie County, Florida:
The North 340 feet of the South 983 feet of the NE 1/4
of the SE 1/4 of Section 5, Township 36 South, Range 40
East,
by deeds recorded in O.R. Book 195, pages 2266 and 2267 and in
O. R. Book 196, pages 2339, 2340, 2341, 2342 and 2343; and
WHEREAS, the said party of the first part subdivided the
above described real property by plat of Twelv~ Oaks Estates, .
filed May 5, 1972, in Plat Book 16, page 26 of the public records
of St. Lucie County, Florida; and ~
WHEREAS, the parties of the second part purchased Lots 1
through 25 of the said Twelve Oaks Estates as per said recorded
plat by warranty deed of conveyance from the party of the first
part recorded in O.R. Book 212, page 2154 of the public records
of St. Lucie County, and remain the ow~ners and holders-af all of
said lots, less and except Lots 1 and 2, and
WHEREAS, the legal description as above set forth of the
lands deeded to first party, most of said lands now being compre-
hended by the recorded plat of Twelve Oaks Estates, overlap the
i legal description of the lands comprising the unrecorded plat of
` Daniels Subdivision, to wit:

The North 375 feet of the South 1/2 of the NE 1/4 of
the SE 1/4 of Section 5, Township 36 South, Range 40
East, St. Lucie County, Florida,
and uncertainty has resulted as to the proper location and descrip-
tion of the common line separating the ownerships of the parties
hereto, and,
WI~REAS, the parties hereto have by agreement employed
A. G. We~th~rzngton & Associates, Inc., Registered Land Surveyors,
to permanently mark the common boundary mutually agreed upon by
~ the placement of three-inch concrete reference monuments at each

~ Northerly lot corner of the lots of Daniels Unrecorded Subdivision, .
