shall be treated as and paid for as a part- of the common expense of
the Association unless specifically provided otherwise in this
Declaration and the Exhibits hereto. Should said maintenance, repair
or replacement be caused by the negliqence or misuse of a unit owner,
his family or the guests, servants and invitees, he shall be respon-
sible therefor, and the Association shall have the right to levy an
~ssessment against the owner of said unit, which assessment shall
have the same force and effect as all other special assessments.
Where a limited common element consists of a terrace, balcony or
screened porch, the unit owner who has the exclusive right to use
the same, where applicable, shall be responsible for the maintenance; ~
care and preservation of the paint's surface of the interior portions ~
of said items, all screening thereon, and glass and other doors leading
to same and all wiring thereto.
The Developer shall have the right to construct, at such
specific Iocations within the parking areas as designated on Exhibit
I of this Declaration, at its sole discretion, such number of covered t
parking spaces as it determines within two (2) years from the date of
this Declaration. Each covered parking space shall bear an identi-
fying letter or number, and no covered parking space shall bear the _
same identifying letter or number as any other covered parking space
or uncovered parking space. Each covered parking space is a limited
common element and the Developer shall have the right to designate
the use of a specific covered parking space to a unit owner for his
exclusive use - said designation shall be made in an instrument of ~
conveyance by the Developer having the same formality as a Deed, and :
same shall be recorded in the Public Records of the county in which ~
this Declaration is recorded. The unit owner who is designated to ;
have the exclusive use of a covered parking space may, thereafter, j
notwithstanding the provisions of Article IV of this Declaration,
sell and assign the exclusive use of the said covered parking space,
not only to the purchaser of his unit, but he may sell, convey and
assign the exclusive use of said covered parking space to the unit
owner of another unit in this Condominium subject to the terms hereof.
Al1 maintenance, repaving, repair or replacement, and upkeep of said
covered parking spaces shall be deemed a part of the conunon expenses
of the Association.
As to uncovered parking spaces, the Board of ~irectors of
the Association shall assign specific uncovered parking spaces to
~ the unit owners in this Condominium. All uncovered parking spaces
~ are located within the parking areas shown and designated on Exhibit
; I attached hereto. The assignment of an uncovered parking_space
shall not be recorded in the Public Records of.the county in which ~
this Declaration is recorded. The Board of Directors of the Asso- i
ciation shall have the right to change the assignment of such speci-
fic uncovered parking spaces from time to time as to the~unit owners
in-this Condominium as it deems advisable in its sole discretion.
Each Condominium unit shall be entitled to the exclusive. use.of one
(1) uncovered parking space; however, where a unit has been assigned
the exclusive use of a covered parking space, it shall not be entit-
led to an uncovered parking space. A portion of the uncovered
parking spaces may be for the use of guest parking and/or additional
parking spaces for Condominium units in this Condominium as determined
by and pursuant to the Rules and Regulations adopted by the Board of
Directors of the Association. Each uncovered parking space is given
~ an identifying number or letter and no uncovered parking space bears
the same identifying number or letter as any other uncovered parking
~ space or covered parking space. The number or letter and location
of each uncovered parking space is not set forth on the Survey Exhibit
~a attached hereto as Exhibit I. When a specif ic uncovered parking
~ spac.e is assigned to a unit owner, it shall be deemed a 2imited
common element for the exclusive use of said unit owner, subject,
~ however, to the foregoing provisions as to the right to change
~ assignments. The term "unit owner" as used in this Article shall
mean and include said unit owner's lessee or the occupant of a unit
~ .
