HomeMy WebLinkAbout0635 areas (qolf course, tennis facilities and beach club facilities), some roads, some riqhts of way, some easements, some parking areas, green belts or scenic areas and maintenance facilities may be con- veyed or otherwise transferred to said Property Ownera' Association pursuant to the Articles of Incorgoratfon, By-Laws and Covenants ~ and Restrictions thereof as the same are recorded upon the Public f Records of St. Lucie County, Florida, and as they may hereafter be ~ amanded. Said Articles of Incorporation, By-Laws and Covenants and Restrictions are by reference made a part hereof as if they had been recorded as an exhibit to this Declara~ion of Condominium. The Property Owriers' Association may sell annual social ; memberships for the beach club, dining room, golf and tennis facil- ities to non-unit owners under such terms as 3t deems advisable. Said Property Owriers' Association shall be responsible for the entire maintenance, upkeep and reconstruction of Said facilities ~ from the time of theiz construction. The assessments of the Property ~ Owners' Assoc'iation may be made directly to the members or through z the Condominium Association to the unit owners and if so, assessments . are declared to be common exper~ses of the Condominium; however, said assessments from the Property Owners' Association may be made in the form of a specified sum per unit which sum may be ecrual for each unit and not apport3.oned according to the oercentages specif ied in Exhibit : A attached hereto; in any event, said assessment shall likewise be ; treated as a common expense of the Condominium. By its execution of ~ this Declaration of Condominium, the Association thereby agrees if ~ reqLested by the Property Owners' Association to collect the assess- ments of the Property Owners' Association as such common expenses and remit them to the Property Owners' Association. It shall be mandatory for the unit owner to make said paymente, regardless of whether or not said unit owner uses all or any of the said facilities. Likewise, the Condominium Association may contract with the Propertv Owners' Association so that the Property Owners` Association will callect the Condominium Association's assessments and remit said assessments to the Condominium Association; in such event, the assessments of the Property Ownera' Association shall also be cotromon expenses of the Condominium. The Condominium Association, by virtue of its eicecution of this Declaration, and each unit owner by virtue of his taking title to a condominium p~rcel, agree that to secure the unit owner's obli- gation to pay his assessment, the~Property Owners' Association shall ~ ~ have a lien on each Condominium parcel and all tangible personal ~ property located in each Condominium unit in this Condominium as ; ' provided in the Articles of Incorporation, By-Laws and Covenants and Restrictions of the Property Owners' Association. ~ Each unit ot~mer, his heirs, successors and assigns, shall ~ be bound by said Articles of Incorporation, By-Laws and Covenants ~ and Restrictions of the Property Owners' Association to the same ~ extent and effect as if he had executed said documents for the purposes therein expressed, including but not limited to: A. Subjecting all of his right, title and interest in his Condominium parcel and tangible personal property therein, to the lien rights granted to the Property Owners' Association in said documents. ~ B. l~dopting, ratifying, confirming and consenting to the execution of said documents by the Association. C. Covenanting and promising to perform each and every ~ ~ of the covenants, promises and undertakings to be performed hy unit ~ owners in the cases provided therefor in said documents. D. Ratifying, conf irming and approving each and every provision of said documents, and acknowledging that all of the terr.is and provisions thereof are reasonable. _ ~ ~ .
