Whenever in the judgnnent of the board of directors of the Association
~
the common elements shall require additions, alterations or im- ~
provements costinq in excess of $5,000.00, such additions,
alterations or improvements must be approved in writing by record
owners of seventy-five percent (75$) of all apartments.
The cost of such additions, alterations or improvements shall
be a common expense and so assessed. Any such addi.tions,
alterations or improvements shall not interfere with the rights of
any apartment owner without his consent (except to raise the amount
of his assessment if approved as aforesaid) and moreover the cost of
. any such addition, alteration or iinprovement cannot be
assessed as a comanon expense aqainst a mortgagee described
in Article XVI hereof, which shall have acquired an apartment ~

at the time'of such assessment as a result of owning a mortgage, `
unless such mortgagee shall have approved such expenditure. Any
additions, alterations or improvements of the common elements ~
costing less than $5,000.00 may be made by the Association with-

E out the approval of the owners and the cost thereof shall con- ~

~ stitute part of the common expenses and shall be assessed against
~ all apartnnent owners, including the aforesaid mortgagees, if any,
who may then be owners.
D. Limitation~of liability of Assaciation. Notwithstandinq
the duty of the Association to maintain and repair the common
elements, the Association shall not be liable to an apartment
owner for injury or damage, other than the cost of maintenance
and repair, caused by any latent condition of the common
elements or caused by Acts of God or by acts of o~er apartment
~ owners oX persons.
