owner, his heirs, successors, and assigns,-shall be bound :

by said manaqement agreement to the same extent and effect ~
as if he had executed said aqreement for the purposes therein ~
expressed, including but not limited to adoptinq, ratifyinq and
confirminq the execution thereof by the Association. It is
specifically recognized that the Developer is a~tockholder,
director and officer of the aforesaid managing agent and that
such circumstances shall not and cannot be construed or con-
sidered as a breach of any duties and obligations to the
Association or its~members nor as a ground to invalidate the
management agreement in whole or in part.
, ~ ARTICLE XI: SANITARY SEWLR -
The Association shall be responsible for,providing sanitary
sewer service for the apartments and the expense incurred in
securing such sewer service shall be a common expense. It is
specifically understood that the Association shall not be
responsible for maintaininq or repairing plumbing facilities
; and fixtures within an apartment except as heretofore provided

ART~CLE XII: ASSESSMENTS
~ A. Method; default. The making and collection of assess-
ments against unit owners for common expenses, and for reserves
as may from time to time be established by the Association,
shall be pursuant to the Articles of Incorporation and By-Laws
of the Association. T'he payment of any assessment or install-
ment thereof due.to the Association shall be in default if such
assessment or any installment thereof is not paid to the
