and the Associat3.on or the insurance trustee, as the case may be, ~

shall disburse the proceeds of all insurance policies to the
contractors enqaqed in such repair and restoration in appropriate
proqress payments. Any costs of such repair and restoration in
excess of the insurance proceeds shall be shared by the owners
in the same proportion as the share of each owner in the common
elements appurtenant to his apartment; and the Assxiation shall
assess each of the owners for such deficit accordingly.
ARTICLE XV: USE RESTRICTIONS
A. Restrictions. The use of the condominiwa property
shall be in accordance with the following provisions so long as
the condominium exists unless otherwise stated therein:
i. Apartment. Each of the apartments shall be occupied-
only by a family, its servants_and guests, as a residence
and for no other purpose. Lxcept as reserved to the
Developer no apartment may be divided or sub-divided ~
into a smaller unit nor any portion sold-or other-

; wise trarisferred without first amending this

~ Declaration to show the changes in the apartments

to be affected.
~i. Com~non elemehts. Con~aon elements shall be used only
for the purposes for which they a=e intended in the
furnishing of services and facilities for the enjoy-
ment of the apartment owners.
iii. Nuisances. No nuisances shall be allowed upon the
condominium property, nor any use or practice that
is a source of annoyance to residents or which inter-
feres with peaceful.possession and proper use of the :

~ property by its residents. All parts of the condo-
miniwm shall be kept in a clean and sanitary condition,
and no rubbish, refuse or garbage allowed to accumulate ~
nor any fire hazard allowed to exist. No apartment
