same price and at the same terms available to the Association,
such right of first refusal to continue until such time as the
Developer shall have completed, sold and closed on the sale of
all apartn~ents in the condominium, or until three (3) years after
the date of recordinq this Declaration, whichever event shall
first occur. ~
ARTICLE XIX: SASEMBNTS
A. Perpetual and non-exclusive easement in common elements.
The comaaon elements are hereby declared to be subject to perpetual
and non-exclusive easements in favor of all owners for their use
and the use of their lessees' immnediate family, guests and in-
vitees, and for the furnishing of utility services and other ~
services and facilities as may from time~to time be reasonably
required for the maintenance, operation, use and benefit of the
condominium.
B. Easements for encroachments. An easement is hereby granted -
for encroach~nts which now exist or hereinafter occur as a result
of settlement or movement of the apartment building or by .

i inaccuracy in construction or reconstruction after casualty whereby

~ one apartment encroaches upo~ another apartment or upon any portion
of the common elements, or whereby any portion of the comnaon
elements encroaches upon any apartment. A further easement is .
hereby granted for the maintenance of such encroachments so long
as they may exist.
ARTICLE XX: EXCLUSIVE RIGATS OF DEVELOPER ,
