that such expense is not met by the proceeds of in- ~
surance carried by the Association. An apartment
owner shall pay the Association the amount of any
increase in its insurance premiums occasioned by use,
misuse, occupancy or abandonment of an apartment or .
its appurtenances, or of the common elements, by the
. apartaient owner.
ii. Costs and attorheys' fees. In any proceeding arising
because of an alleged failure of an apartment owner
or the Association to comply with the terms of the
Declaration, Articles of Incorporation, By-Laws, or
the Regulations adopted pursuant to them, and all
of such as they may be amended from time to time, the
prevailing party shall be entitled to recover the
costs of the proceedings and such reasonable :

iii. No waiver of rights. The failure+„of the Association
or any apartment owner to enforce any covenant, ~
restriction or other provision of the Condaninium
Act, this Declaration, the Articles of Incorporation,

ARTICLE XXIII: TERMINATION
- A. Bv agreement. The condominium plan of ownership may be ~

B. Certificate evidencing termination. The termination_of
