ARTICLB XXIV s MISCIs"LLANEOUS PROVISIONS
A. invalidity. The invalidity of any provision of this
Declaration shall ~ot be deemed to impair or affect in any manner
the validity, enforceability or effect of the remainder of the
Declaration, and in such event all other provisions of the
.
Declaration shall continue in full force and effect as if such
invalid provision had never been included therein.
~ B. No waiver. No provisions contained in this Declaration
shall be deemed to have been abrogated or waived by reason of any _
failure to enforce the same irrespective of the number of violations
or breaches which may occur.
C. Ca tian. Captions herein are inserted only as a matter
of convenience and for reference and in no way define, limit or
describe the scope of this Declaration or the intent of any pro-
visions hereof.
D. Approval. W'henever the decision of an apartment owner is
required upon any matter, whether or not the subject of an
Association meeting, such decision shall be expressed by the same
person who would cast a vote of such owner if in an Association
! meeting, unless the joinder of record owners is specifically re-

quired by this Declaration.
E. Gender. The use of masculine gender in this Declaration ~

shall be deemed to refer to the femine gender.and neuter gender
whenever the context so requires; and the use of the singular
shall be deemed to refer to the plural and visa versa whenever
the context so requires. ~
F. Personal Representatives, heirs and assigns of Developer.
_ Whenever reference has been made ta the Developer in this
~ Declaration, such reference shall be deemed to also include the
~ personal representatives, heirs and assigns of Developer.
