HomeMy WebLinkAbout1347 Mortgagor fully warrants the title to said land and will defend the same against the lawful claims of ~11 persons whomsoever, and agrees: l. To make all payments required by that note and this mortgage promptly when due. . 2. To pa~y all taxes, assessments, liens and encumbrances on that property promptly whe~ due. If they are not promptly paid the Mortgagee may pay them without waiving the option to foreclose, and such payments, Nith interest L~reon from the date of payment at the same rate as specified in that note, shall also be secured by this Mortgage. 3. To conmit, permit, or suffer no waste, impairaient or deterioration of the mortgaged property. ~ ~ 4. To pay a11 expe~ses reasonably incurred by the Mortgagee because of fail- ~ ure of the Mortgagor to canply Nith the agreements in that note or this Mortgage, in- ~ cluding reasonable attorney's fees and title searches. The cost thereof, with in- terest thereon from the day of payment at the same rate as specified in that note, sha11 also be secured by thls Mortgage. . 5. Not to convey all or any portion or i~terest in the mortgaged property wlthout the prior written consent of Mortgagee. 6. If any payment provided for in that note is not paid within 30 days after it becomes due, or if ar~y agree~nent in this mortgage other than the agreement to make the payments is breached. the entire unpaid princlpal balance of that note shall im- mediately become due at the option of the Mortgagee and Mortgagee may foreclose this mortgage in the manner provided by taw, and have the mortgaged property sold to satisfy or apply on the indebtedness hereby secured. • 7. The rents and profits of the mortgaged property are also hereby mort- gaged and if proceedings to foreclose this aartgage shall be instituted, the court having ~urisdiction thereof should appoint a receiver~of the mortgaged property and apply those rents and profits to the lndebtedness hereby secured, regardless af the solvency of the Mortga4or or the adequacy of the security.
