THIS CAUSE came on to be heard on Plaintiff's motion to
strike Defendants' answer and any amendment thereto and to
render a default judgment against the defendants and to pay
the expenses reasonably incurred by the plaintiff, including a
reasonable attorney's fee,_upon the grounds that the defendants
~~had failed to comply with an order of this Court dated September 6,
1974; and.it naw agpearing that the defendants have in effect
cqmplied with said order and the plaintiff having withdrawn
his request for expenses and attorney fees, it is therefore

ORDERED that said motion be and the same is hereby denied.
