POPOVICH, deceased, party of the first part, and CHESTER L. BURNS, JR., of

WITNESSE~H:
WHEREAS, the said NICHOLAS POPOVICH departed this life in
St. Lucie County, Florida on the lOth day of March, 1974, leaving a last
will and testament wherein the party of the first part was named as

` to probate on the 15th day of March, 1974, by the Circuit Judge of St.

WHEREAS, the said NICHOLAS POPOVICH, JR. is the duly qualified
~ and acting executor of the estate of NICHOLAS POPOVICH, deceased, and under
the terms and provisions of said last will and testament the said NICHOLAS
POPOVICH, JR. is duly empowered to sell and dispose of the reaY estate

belonging to the said testator at the time of his death.~
NOW THEREFORE, the said party.of the first part, by virtue of
the power and authority to him given in and by the terms and provisions of
` the said last will and testament of NICHOLAS POPOVICH, and in consideration

of the sum of Forty-five thousand ($45,000.00) Dollars, does hereby grant,
bargain, sell, and convey-unto the party of the second part and his assigns
~ that certain parcel of land lying and being in the

West 30 feet for Counfiy road right-of-way, as recorded in

Road, and LESS the North 425 feet; ALSO SUBJECT to a 12-foot
drainage easement and right-of-way along the East 12 feet
~ as granted to St. Lucie County and recorded in O.R. Book 179,
= page 1596, of the Public Records of St. Lucie County, Florida.
Subject to that certain first mortgage from the Grantees heceof
to First Federal Savings and Loan Association of Fort Pierce,
dated 9/11/74, recorded in O,R. Book 232, page 91 of the public
records of St. Lucie County, Florida, securing the original ~
