CCNSTRUCI'ICN CCMPA?QY INCCRPCR.ATED and BEACH CLUB CCLCNY CF STUART, INC., both Flori3a Corporations and GECRGE APCSTCLCPCULCS, individ- ~ ~ ually, hereina.fter referred to as MCRTGAGCRS. ~ _ WITNESSETH: - WHEREAS, the Mortgagees are the holders of two (2) Promissory Notes both dated Sep~ember 29, 1972, executed by Bea.ch Club Colony . of Stuart, Inc. , one in the amount of ~7~, 000, 00 and the other in the amount of $30, 000.00, which notes are secured by a Mortgage of the same date, execute3 by the aforesaid party recorded in Cfficial Records Book 20fi at page 2437, Public Records of St. Lucie County, Florida, which Mortgage encumbers the described property attached to said - Mortqage as Exhibit "A" . WHEREAS a Mortgage 1Vlodification and Lien Transfer Agreement f ~ ~ dated September 4, 1973 ~,~as executed by the Mortgagees and G. A. ~ Cons~ruction Company Incorporated and recorded September 5, 1973 ~ . in Cfficial Records Book 218 at page 696, Public Records of St. Lucie County, Florida and recorded September 28, 1973 in Cfficial Records Book 363 at paqe 2547, Public Records of Martin County, Florida release+d the property described in said Exhibit "3" and "C" atta.ched to the said Mo - gage Modification and Lien Transfer Agreement. WHEREAS tha pa.rties ackno~vledged that the said Mortgage and Mortgage Modifica.tion and Lien Transfer Agreement and both Promissory Notes owned by the Mortqa.gees were due and pa.yable on September 29, 1974 an~ that no pa.yment on the principal has been made.
