4.~ Proprietor agrees that no other aaohines of the same kind
Nill be uaed or be permitted to operate in the above desaribed pre,i8es
durinq the ter~ of this Agree~ent, and that a violation of thia proviBion -
ahall be dee~ed a matarial breach of this Agreesent, it being the
intention of the parties that the Co~pany's maahines, as herein set out
be used eacluaively in eaid premises.
4-A. It ia the intention of the parties that the definition
of "~achine8 of the same kind,' as set out in paragraph be interpreted
as follo~s: (the folloxing ezamples are not meant to be eaclueive) .
l. If a music maohine i8 placed on the prenisea by
the Company under the terms of this Agreement, then proprietor
; shall not uee, operate or pereit to be operated~upon said
premises, any other machines xhich play nusic ar Mhioh ehox
piatures in con~unction xith playing nusia.
~ ~ 2. If an amusement game 18 placed on the premises by
the Company under the term of tbie Agreement, then no other
coin-operate8 amusement gamea of any kind shall be used,
operated or be permitted to operate upon said premises.
5. In the event of a breach of any of the terms of thie Agree~ent
by the Proprietor, the Company may~elect to terminate thia Agree~ent,
and in auch eveat it~is hereby agreed that the Company shall be entitled
to recover, as liquidated damages, a sum of money equal to the number of
xeeks remaining in the term of this~~contract multiplled by the average
Keekly gross profits of the Company fro¦ the operation of said machines
up to the date of the breach.
