As to the validity of the contract itself~ the Court ~ determines that it was a valid contract even though it was signed only by Mr. Tavernese and not 3oined by his wife. 7. That the failure to complete the contract was not the ~ result of any failure -on the part of the plaintiff TAVERI~ESB to deliver or any defect in his title, but the reason the contract failed was that there was not the additional deposit called for vonder the terms of the contract. ~ 8.
