FINAL JUDG~NT OF FORECLOSURE _
This cause having come on for final hearing on November
13, 1974 upon the Complaint, Answer, Counterclaim and Answer to
Counterclaim filed herein, and the Court having heard testimony
_ of witnesses produced by both parties and the arguments of counsel,
and the Court being otherwise fully advised in 'the premises and
having j urisdiction of the parties and of the subject matter, it
,
. is therefore,
ORDERED AND ADJUDGED, as follows: -
1. That the equities of this cause are with the plaintiff
. ;
LAURIS HAMILTON and against the defendant HENRY G. WHITE.
2. That the defendant HENRY G. WHITE-failed to prove the
allegation of liis.counterclaim and that said counterclaim is hereby
denied. ~
~ 3. That the allegations contained in.the Complaint have
~
~ been proven by competent evidence and that there is now due and ~
owing to the plaintiff from the defendant Henry G. White on the
~echanic's lien described in the Complaint, the sum of EIGAT HUNDRED '
EIGHTY-SEVEN and 60/100's DOLLARS'($887.60), together with interest
thereon as allow~d by law from the llth day of July, 1974 to November
13, 1974-in the amount of $18.24, and each day thereafter on a per
diem basis, and attorney's fee payable to Spencer B. Gilbert, _
~ attorne for the plaintiff herein, in the amount of $400.00, which

~
~ the Court finds to be a reasonable fee in this cause, costs and
court costs in this action in the amount of $113.98, for a total sum
of $1,419.82, and all such sums are secured by the lien herein
foreclosed.
