O R D E R
This cause came on for final hearinq on November 7, 1974
and the Gourt having heard testimony of the respective parties
and argument of counsel for the respective parties, finds that ,
technically the Defendants are in default in failing to make the
monthly installment payments on time or during the grace period
and in failing to provide insurance, but that the Court will not
honor Plaintiff's right to declare the full amount due and pay-
able under the note and mortgage because of said default. It is,

~ ORDERED AND ADJUDGED as follows: .
. l. The Defendants, Victor M. Jones and Linda Jones,
shall pay to the Plaintiff the sum of $410.00, being the costs
incurred by the Plaintiff in and about the prosecution of the
foreclosure of the note and mortgage, being the subject matter
of this suit, in the manner following: $100.00 on December 1,
1974 and $100 on the first day of each month thereafter until
the full amount oF $410 has been paid.
~ 2. That upon payment by the Defendants to the Plain-

tiff of the said sum'in the manner above set out the above
entitled'cause shall be dismissed without prejudice.
