t~. MUTUAL RELEASE. Except as otherwise prov[ded in this ;
Agreement, each party releases the other from all claims or demands up ~ ~
to the date a~f the execution of this Agreement. Except as otherwise provided,
each party ~vaives, releases and relinquishes all rights that he or she may
have or may hereafter acquire ns the other party's spouse under the present
or future laws of any jurisdiction:
(a) To elect to take against any Will or Codicil o~ the other
party now or hereafter in force; ~
(b) To share in the other party's estare; and
(c) To act as Exeaa tor or Administrator of the other party's
estate. •
7. SUI3SEQtJEI~T DISSOLU'I'ION Or MARRIAGE. Nothing contained
in this Agreement shall be construed to prevent either ~party from i~nstituting
~ ~ ~
an acrion for dissolution of marriage in an} competent Jurisdiction against t ~
other because of any past or future fault on the other's part, subject to the
following: .
~ (a) In any action for ~dissolurion of marri.age, the Wife,

! provided the Husband is not in default under this Agreeinent, shall make no
! ~
~ claim for alimony, eother temporary or p°rmanent, for suit money, either
temporary or permanent, for support for the child(ren), either t~emporary or
permanent, or for attor. ney`s fees, e~cept in accordance with the provisions
of this Agreement. ~
(b~ This Agreement may be offered in evidence by either
party in an~~ action for dissolution of marriage and, ~f acceptable to the
Court, shall be incorporated by reference in the judgment that may be .
rendered. However, notwitl~standing incorporation in the judgment, this
Agreement shall not be merged in it but shall survive ti~e judgment aixl
be binding on tl~e parties for all tiine.
