THIS CAUSE was com~nenced by JOHN A. MENDES, as Trustee, Plain-
tiff, filing a Complaint aqainst JOHN R. DISHL and LOUISE R. DIEHL, his
wife, Defendants, for reformation of a deed legal description to-conform

property. By Defendants' Answer and Counterclaim and subs~quent Amended
Crossclaims and Counterclaims, the parties were before the Court as set

~forth in the style above. For purposes of convenience hereafter, the
parties snall be designated as MENDES, Plaintiff and Counterdefendant; ~
MONTGOMERY, Crossdefendant; and DIEHIS, Defendants and Counter and Cross
glaintiffs.
This cause came on for trial before the Court on November 20,
1974, without a jury, both parties being represented by counsel, the
Court havinq heard the testimony of the witnesses for the parties, hav-
ing examined the evidence and hea~ring arqwaents of counsel, enters its
findings and Final Judgment as follows: ~
1. The Court finds from the evidence that there was an unin-
tentional error made in the legal descriptions in the deed and mortgage'
