Orange-Co of Florida, Inc., a Florida corporation, formerly
Lak~ Hamilton Citrus, Inc., and The Equitable Life Assurance
Society of the United States, a New 'York corporatio~, throuqh
their undersigned attorneys, state: -
1. Orange-Co of Florida, Inc. is the fee simp~e own~ -
the lands described in this proceeding a~d referred to as
Parcel #106. . - ~
2. The Equitable Life Assurance Society of the Onited
. -
~ States is the owner and holder of a certain mortgage encumbe=ing
~ Parcel #106 dated December 21, 1972 and recorded in O. R. 209,
~
page 976, et. sec. of the St. Lucie County, public records. _
3. An Order of Taking said Parcel #106 was entered in this
Cou=t on November 15, 1974. :

4. The Delaration of Taking filed herein as amended on ;
December 4, 1474 reveals that the Petitioners good faith estimate
of value of Parcel #106 is $215,890.00 and said funds were
deposited into the registry of this Court on December 2, 1974.
~ 5. The Equitable Life Assurance Society of the United States
~ has agreed to release their lien on said lands upon payment to
thesn of $70,000.00 and the Orange-Co of Florida, Inc. has agreed
to the payment of said funds to said mortqageholder.
WAEREFORE, the parties hereto move the Court to enter an
Order directing the Clerk of the Circuit Court to pay ~froza the
