5. Max L. Bloch, individually, is not a proper party
Defendant because of the Assigrunent executed by Emily H1och on
February 28, 1970, a copy of which is attached to this Order as
8xhibit A. Therefore, this action as to Max L. Bloch, individually,
is dismissed with prejudice. .
6. A copy of the Trust Agreement between the Defendants
concerning the real property described in the Plaintiff's Complaint
is attached to this Order as Exhibit "B".
7. The Defendant named as "Beatrice Adams" in the
Plaintiff's Complaint is one and the same as "Beatrice Abrams", for
whom an answer has heretofore been filed.
` 8. All of the issues raised in the Plaintiff's Complaint
have been amicably resolved~by the sale of the real property des-
cribed therein by~the Defendants to the Plaintiff.
9. This action, as to the Plaintiff, Jack Cummings, as _
Trustee, is dismissed with prejudice and his Lis Pendens is hereby
cancelled of record.
