5. Max L. Bloch, individually, is not a proper party ~
Defendant because of the Assignment executed by Emily Bloch on
February 28, 1970, a copy of which is attached to this Order as
Exhibit A. Therefore, this action as to Max L. Bloch, individually,
is dismissed with prejudi~e.
~ 6. A copy of the Trust Agreement between the Defendants
concerninq the real property described in the Plaintiff's Complaint
is attached to this Order as Exhibit "B".
~ . 7. The Defendant named as "Beatrice Adams" in the
Plaintiff's Complaint is one and the same asr"Beatrice Abrams", for
whom an answer has heretofore been filed.
All of the issues raised in the PTaintiff's Complaint
have been amicably resolvEd by the sale of the real property des-
cribed therein by the Defendants to the Plaintiff. +

9. This action, as to the Pla~intiff, Jack Cummings,_as
Trustee, is dismissed with prejudice and his ~is Pendens is hereby
cancelled of record.
10. Defendant, Max Bloch, as Trustee, sha11 have twenty
(20) days from the entry of this Order in which to file a.Cross-
claim in this action.
