This cause came on for hearinq before me on motions for
summary judgments filed by all defendants and on pla~intiff's _
motion to strike certain defenses, and the Court having con-
sidered argument by counsel for the parties, and the Court
having directed the filing of citations of authority by
counsel as to certain points of law for the Court's consider-
~ ation, and the Court'being fully advised_in the premises, it -

is thereupon
ORDERED AND ADJUDGED as follows:
1. The motion for summary judgment by the defendants
George Coppola, et al, d/b/a, The Coppola Company as to
Count III of the amended complaint is hereby granted; as to _
Count II of the amended complaint, ruling is reserved on -
said motion.
2. As to the motion for summary judgment by the defen-
~ dants Lester~and Cox, the same is denied as to Count III of
~ ~
~ the amended complaint; further, as to said motion by the
defendants Ruth W. Lester and Joan P. Cox on the ground that
their joinder in the execution of the contra~t sued upon
