conditions~ reservations, or restrictions, by reason of such breach,
all costs incurred in such enforcement including a reasonable fee
for counsel shall be paid by the grantae, his heirs or assigns, and
the,grantor, its successors or assigns, shall have a lien upon such
property to secure payment of all such accounts.
12. Grantor expressly reserves the right to release grantee
from any or a11 of the restrictions, conditions, reservations and
convenants herein imposed at any time, by written instrument in;
such-form-as to entitle_it__to_be__gl~c~_d_of record in the public
records of St. Lucie County, Florida.
13. All of the conditions, covenants, restrictions, and reser-
vations set forth herein shall run with the land and the grantee,

by accepting the deed to said premises, accepts the same, subject to

such conditions, covenants, restrictions,~and reservations and agrees
for himself, his heirs and assigns, to be bound by each of such con-
ditions, covenants, restrictions and reservations jointly, separately
and severally.
.14. The covenants and restrictions set forth in Paragraph 1
hereof shall cease, terminate and be of no further force or effect

~ at such time as grantor, it successors or assigns shall use any por-

E tion of the property presently owned by grantor abutting the man-

~ made channel and not conveyed he~ceby for any substantial purpose ~

~ other than (i) marine research, scientific, educational purposes,
(ii) commercial purposes similar to those for which sri~'h property
is presently being used by grantor or its lessees, or" (iii) single,
~ one-family residential purposes.
~ 15. The covenants and restrictions set forth in Paragraphs ~ ~

~ 3, 8, 9 and 10, respectively, shall cease, terminate and be of no
~ further force or effect at such time as grantor, its successors or
~ assigns, sha11 fail to observe the same restrictions with respect
~ to any of the property presently owned by grantor abutting the
~
~ man-made channel and not conveyed hereby.
~ 16. Grantor warrants and covenants that grantee w~ll at all
~ ~
~ - times have water~ingress to and egress from the described property
~
through the channel described in that certain Channel Easement
~
