dismiss the plaintiff's second amended complaint, and upon the ;
joint motion of counsel that the same be removed from the trial '
docket, and the Court having heard the argument of counsel and
being otherwise duly advised in the premises, it is thereupon

ORDERED AND ADJUDGED as follows:

(1) That the joint motion of counsel be granted and that ;

hereby removed from the trial docket and will be re-set upon the
