FINAL JUDGMENT ~ ; ~ THIS CAUSE was conm~enced by HESTER BUILDERS, INC., a Florida corporation, filing a complaint against ELISHA STATON, ~C. W. DORDEN, EULA MONROE, MITCHELL McCARTY, REV. S. P. RILPATRICR, CALVIN JOffi1SON, ESRIA HAYES and JAMES CARSWELL, as Trustees of the Mt. Pleasant Primitive Baptist Church, to foreclose a mechanic's lien. By the defendants' answer and counterclaim, the parties - ~ were before the Court as set forth above. For the purpose of ~ ~ convenience, the parties shall hereafter be designated as "Hester", t L plaintiff and counterdefendant; and "Trustees", defendants and counterplaintiffs. ; This cause came on for trial before the Court on February 18, I ~ 1975, without a jury. Both parties were represented by counsel. s The Court, havinq heard the testimony of the parties and of the ° ~ `t E witnesses for the parties, having examined the evidence, having ~ 4 heard the argument of counsel, and being otherwise duly advised in the premises, finds as follows: ~ (1) The Court finds•from the evidence that there was a ; ~ ~ } contract between Hester and the Trustees for the construction, by ~ ~ ; ~ Hester, of a church building, in consideration of the payment by ~ ~ the Truat~es to Hester of the sum of $108,~00.00; and that after ~ , ~ Hester undertook the performance of this contract it was modified ~ or abandoned by the parties. Following the m+~dification or aban- ~ , , ~ donment of this contract, Hester continned to work and perform ~ { ~ ~ ~ services in connection with the construction of the church for the ~ ~ Trustees, and is therefore entitled to a reasonable compensation ~ ~ ~ ~ . ~ ~ ~ g~~ P~2246 ~ ~ ~ ~ . f z _ ~ , _ - - - _ - _ .M~~
