(3) TMerefore, the Court further finds that Hester was ; ~ entitled to no additional money under the foreqoinq Claim of Lien and therefore the Lien should properly be diamiased and the notice of Lis Pendens filed purauant thereto discharged. ~ Because of this, the Court also detenaines that Hester is not entitled to recover an attorriey's fee in this action. (4) The Court finds that as to the counterclaim filed by ~ : E ~ the Trustees against Hester, the counterclaimant failed to meet ; , ~ their burden of proof, ~ ~ W~REUPON, it is therefore ORDERED AND ADJODGED that: ~ (a) On the complaint, the Court finds for the defendants and against the plaintiff and the Claim of Lien recorded in O. R. Book°172 ~ € at Page 2097, as well as the notice of Lis Pendens filed pursuant ~ thereto and recorded at O. R. Book 173 at Page 2294, be and the ~ i ~ aame are hereby dismissed and discharged, and the plaintiff shall , ~ go hence without day. : (b) On the counterclaim, the Court finds for the plaintiff ~ ~ ~ and counterdefendant and against the defendants and counterplaintiffs ~ and the defendants and counterplainti€€s shall go hence without day. ~ ~ ; (c) 8ach party shall bear their oWn Court costs incurred ~ in this case. ~ ORDERED at Fort Pierce, St. Lucie County, Florida, this ~ day of February, A.
