ORDER ON ORDER TO SHOW CAUSE

Upon representation made to the Court fram both counsel
representing the respective parties, to-wit: ROBERT D. MELTON
of ROBERT D. MELTON & ASSOCIATES, P.A., on behalf of the Plaintiff,
ALLIS-CHALMERS CORPORATION, and SPENCBR GILBERT, on behalf of
the Defendant, AL POLIZZI, d/b/a AL POLIZZI RENTALS a/k/a AL'S
EQUIPMENT RENTALS, the Court has found that the Defendant, AL
POLIZ2I, does not claim ownership or right of possession in said ~
goods, except for a claim for storage charges and that the Court ~
~ further finds the Defendant, AL POLIZZI, does not object to the
possession of the goods being turned over to the Plaintifi by
! the Sheriff of St. Lucie County, since the goods were taken into
possession by the Sheriff of St. Lucie County on February 26, 1975~
f
! pursuant to an Emergency Writ of Replevin issued by the Clerk
~
~ pursuant to an Order entered by t-his Court, and the Court finds
~
that the Defendant does consent to an Order being entered ordering .
the goods to be turned over to the Plaintiff, however, there are ~
remaining issues in this cause which include the claim o~ the ;
~
~ Defendant for storage charges and the claims of the Plaintiff for !
i
~ wrongful withholding of the goods by the Defend~nt,;los~`of
~ ~
~ use and depreciation of the goods, damaqes for trie same together
r with punitive damages, which claims of the Defendant and Plaintiff
~ are not settled by the entry of this Order, but shall be joined by
~
~ appropriate pleadings filed in this cause by the respective parties,
~
~
~ it is th~refore
~ ORDERED AN~ ADJUDGED as follows:
~
~ 1. That the Sheriff of St. Luci~, County, Florida, be and he
~
~ is hereby ordered to deliver the possession of the f~llowing goods
