THIS CAUSE coming on this day to be heard upon the motion
to dismiss amended complaint filed by the defendant Gorham
Construction Co., and the Court having heard argument of
counsel and being advised in the premises, it is hereby
ORDERED AND ADJUDGED that the amended complaint be and
the same is hereby dismissed for failure to state a cause of
action, with leave granted to plaintiff to amend said amended
complaint within ten ,,(10) days of this order. It is further
ORDERED AND ADJUDGED that the defendant Gorham Construction
! Co. shall have ten (10) days from the actual date of filing

` said second amended complaint within which to respor_d thereto.
