It is further ordered that .the Defendant has the right
to file Affidavits on its behalf with the Court and may appear
persona~ly or by way of an attorney and present testimon~ on
its behalf at the time of the hearing, or that it may, upon
- a finding by the Court pursuant to Florida Statute 78.075 (2)

that the Plaintiff is entitled to the possession of the
claimed property pending final adjudication of the claims of
the parties, file with the Court a written undertaking executed
by a surety approved by the Court in a'ri amount equal to the
value of the property to stay an Order authorizing the delivery
~
of th~ property to the Plaintiff;
It is further ordered that if the Defendant fails to appear ~

it sha~l be deemed to have waived its rights to a hearing and ~
~
may or~er the Sheriff, if said Sheriff has_taken possession of #
,

the personal property pursuant to the Emergency Writ of Replevin ;
issued by this Court to deliver the said property to the Plaintiff.
