COME NO~Y the respective parties, by and through their
uiidersigned counsel, and represent unto the Court that pursuant
to the Courtts previous order of May 25, 1970, the Defendant,
WALTER B. HARVEY, has provided to the Plaintiff, a Promissory Note
in the a.mount of ~250,000.00, and secured same with various stocks,
assignments and mortgages; that said Defendant has been continually
advised of the progress of completion of the job under which this =
; action is brought and upon review of the final figure provided to

' him by Plaintiff herein by letter dated April 26, 1971, demanding
I

~ payment in the total amount of ~296,931.62, has agreed to execute
an additional Promissory Note in the amount of $46,931.62, calling
x
for payment under terms satisfactory to the Plaintiff.

~ WIiEREFORE, the parties to this cause hereby stipulate to
~ entry of final judgment in this matter on behalf of the Plaintiff
~
~ and against the Defendant in the total amount of $296,931.62.
