( 2) By inserting the following as a new sentence at the end of the
third paragraph of Section 5:
"For purposes of the foregoing, any Nuctear Fuel subject to
the Lien hereof consumed in the operations of the Company shall
; be deemed Funded Property disposed of free of the Lien of this
! lndenture."
( 3) By inserting the following as a new second paragraph of
Section 6:
"The term `Excepted Encumbrances' shall also mean and
inelude as of any panicular time any controls, liens, restrictions,
regulations, easemencs, exceptions or reservations of any govern-
mental authority applying particularly to Nuclear Fuel." ~
k ( 4) By inserting af'ter the word "implements" each time it appears
' in clause (1) of Section 58 the words Nuclear Fuel or any
' components thereof,"_
( 5) By inserting the foUowing as a second paragraph of Section 58:
"The Company may at any time or from time to ume, without
' any release or consent by, or report to, the Trustees or either of
[hem, consume in its operations Nuclear Fuel subject to the Lien
hereof if and so long as the Company shall maintain adequate
records of the Cost of such Nuclear Fuel so consumed."
( 6) By modifying Section 28( 7)( b) to read as 1'ollows:
_ b) that the ownership and operation of the Property
; Additions in res~~! ~f which the application is made are within
= the cor~xirate powers of the Company; and"
~ ( 7) By modifying Section 39( I)( 2~ to read as follows:
ra 2) the amount which is ten per centum ( 10°b ) of such
Adjustzd Gross Operating Revenues ( but the amount required to
_ be stated by this clause ( 2) in such certificate s~all not, in any case,
~ exceed the aggregate of ( w) the amount required to be stated by
r-~ clause (3 )~low in such certificate, plus ( x)~2,000,000 plus ( y)
~ two per centum ( 2%) of the gross charges to plant account for
additions to depreciahle property of the Company made after
December 3l, 1943 and prior to the beginning of the calendar year
