ORDER ON MOTION TO DISMISS AND MOTION TO FILE THIRD PARTY COMPLAINT
This cause came betore the Court upon the motion of
Defendants CITY OF PORT ST. LUCIE and AETNA CASUALTY & SURETY
COMPANY to dismiss the Plaintiff's complaint and the motion of
Defendant GENERAL DEVELOPMENT CORP. to file a third party complaint.

A hearing was held before the Court on Monday, April 7, 1975 on said
motions. The Court having heard oral argument of respective counsel
and being otherwise fully advised in the premises, it is thereupon
ORDERED AND ADJUDGED:
1. The motion of Defendant GENERAL DEVELOPMENT CORP. to
file a third party complaint against ANDRA MERRITT DAVISON on an
indemnification theory is hereby granted. Said Defendant/Thira
E Party Plaiptiff shall have 30 days from the date of this order

~ whithin which to file a third party complaint.

~ 2. The motiori of Defendants CITY OF PORT ST. LUCIE and

~ AETNA CASUALTY & SURETY CO. is granted. The Plaintiff's attorney

having announced in open Court that he would not attempt to file

~ a second amended complaint against these Defendants, the Court
~ does grant a motion to dismiss with prejudice as to Defendants
~

~ CITY OF PORT ST. LOCIE and AETNA CASUALTY & SURETY CO. The
~ Plaintiff shall take nothing in this action against CITY OF PORT
ST. LUCIE and AETNA CASUALTY & SURETY CO. and the said Defendants

~ shall go hence without day.
