5. Tenant will not make an re a ent of rent other than as ~

event of any prepayment of rent other Lhan as provided for in the Lease, ~
Tenant shall not make any claim for such prepayment should the Fund, its ?

:~agents, receivers, or any other party exercise its right to the collection of

;~rents, or in any way become entftled to said rents.
~ 6. The terms of this Agreement shall be binding upon and inure
'`to the benefit of and be enforceable by the respective successors and assigns
,iof the parties hereto.

7. No modification, amendment, waiver or release of any provision

`of this Agreement or of any right, obligation, claim or cause of action ~

arising hereunder, shall be valid or binding for any purpose whatsoever,

'unless in writing and duly executed by the party against whom the same is

;;sought to be asserted.

8. Tenant shall give the Fund and the Landlord simultaneous

~,written notice of any default by the ~:andlord under the Lease, and the Fund
~ ~shall have the reasonable opportunity, but not the obligation, to cure any

! ' such default on behalf of the Landlord. Nothing herein contained shall affect '

a ~•the agreement of the Tenant not to teraainate, cancel, surrender or otherwise ;

~ ;;modify the Lease or reduce the rent, except as provided for in Paragragh 4 ;
