For vaZue received, I, we or either of us promise to pay, without
` defalcation, to the order of MEYER C. HELLER and DOROTHY HELLER,
his wife, at Sun Bank of St. Lucie County, Fort Pierce, Florida
the sum of Eighty Thousand and na/100 ($80,000.00) Dollars with
interest from date at the rate of 9% per annum in annual installments
of $8,000.00, together with the annual interest payment which shall
be equal to the unpaid principal amount of the note remaining due.
Each annual payment shall be due on the 20th day of March, 1976 and
$8,000.00 plus interest on the corresponding day of each year
thereafter until the principal and interest are fully paid.
' If default is made in the payment of any installment when due, then
; at the option of the holder, and without any other notice, all the
~ remaining installments shall be due and payable at once. Privilege
~ is given to make prepayments on the principal at any time, if a
` prepayment in any one year exceeds the annua~.principle and interest
~ due hereunder then in that event the following annual payment
~ of $8,000.00 plus interest shall be excused at the option of
~ the maker. Neither forbearance, nor acceptance by the holder hereof
@ after any default in any payment hereon, shall be deemed an ~
extension. -
Each maker, surety and endorser hereof, jointly and severally waives
demand, presentment, protest and notice of protest for non-payment
and further agrees to any extension of time of payment, either
before or after maturity, without notice to any of us; and Co pay all
costs of collection, including a reasonable attorney's fee in the event
~ of any default hereof, and hereby severally waives all benefit of
homestead-and exemption under the constitution and laws of each State
~ of the United States, as against this obligation or any extension or
~ renewal hereof.
