MORTGAGE MODIFICATION AGREEMENT

This instrument, executed this ~ day of
, A.D. 1974, by and between JEROME J. RUTHER,
BASIL C. ELIAS and W. JASON, Individually, and as all surviving stock-
holders and Trust~es of HOLLYWOOD DEVELOPMENT COMPANY, a dissolved
Florida corporation, and as all general partners of NOLLYWOOD DEVELOP-
MENT COMPANY, a Florida general partnership, First Parties, and NORTH
TRAIL GOLF CLUB, INC., a Florida corporation, Second Party, for and
in consideration of the sum of ONE DOLLAR ($1.00) and other valuable
considerations, the parties-,hereby execute this agreement as follows:
W I T N E S S E T Ii:
WHEREAS, First Parties are the Obligors under a certain .
mortgage deed, dated December 20, 1972, recorded in O.R. Book 209,
pages 557 through 565, of the public records of St. Lucie County, .
Florida, which mortgage deed was originally executed by Trafalgar
Community Developers, Inc., and was taken subject to convenance to ;
titleholders and First Parties did assume and agree to pay the afore-
said mortqage by warranty deed from Trafa].gar Community Developers,
Inc., to First Parties, as recorded in O.R. Book 219, page 1036, of

the public records of St. Lucie County, Florida, and
WHEREAS, First Parties did agree to a modification by Stipu-
lation, filed in that certain Circuit Court of St. Lucie County,
Florida, Case No. 74-495, which Stipulation is dated October 30, 1974
' which, artong other things, under Condition 6 on page 3, to modify said

i mortgage and in compliance with ~aid Stipulation, and in consideration ;

~ of the mutual covenants under said Stipulation, do hereby agree as fol-

; lows: First Parties do hereby modify the second purchase money mort-

° gage herein described with the express agreement that this modification ;

s shall not constitute a waiver, release or otherwise affect the second
~
s
; lien position of the Second Party, its successors or assigns, and this ~
~
~ modification shall be effective, for all intents and purposes, as if ~

s executed on the date of the original mortgage and the original recording ~
