by and through Robert M. Ross, Senior Vice President of said
corporation, who having been f irst duly sworn deposes and says:
(1) That Af f iant is the owner (or agent of the
owner) of the property listed on Exhibit "A" attached hereto ~

and made a part hereof, ~
(2) That Affiant as owner entered into a construc- '

tion agreement with R. E, Bell, Incorporated as Contractor
on May 6, 1974, wherein R. E. BELL INCORPORATED agreed to

complete the construction of homes on the property listed on

Exhibit "A" were in various sta~es of construction, that on ~

March 31, 1975, R. E. BELL INCORPORATED was informed of ~

their default under that certain construction agreement
- between GENERAL DEVELOPMENT CORPORATION and R. E. BELL '
INCORPORATED dated May 6, 1974, and that on~tr~~u'-~ I 3~ t~ly

construction on those properties listed on Exh~ibit "A" ~
; ceased.

` (4) That Aff iant wishes to recommence construc-

~ tion on those properties listed on Exhibit "A" and pursuant =

to Florida Statutes ~713.07(4) hereby gives notice of said ~

~ intention to recommence. ~

(5) That all lienors giving notice have been paid
in full except those listed on Exhibit "B" attached hereto
and made a part hereof.
