TOGETHER with all tenewents, hereditaments, and appurtenances ;

thereto belonging or in anywise appertaining. ~

TO HAVE AND TO HOLD the same in fee simple forever. , ~
AND the grantor hereby covenants with said grantee that it is ~

lawfully seized of said land in fee simple; that it has good right '

and lawful authority to sell and convey said land, that it hereby
fully warrants the title to said land and will defend the same
against the Iawful claims of all persons whomsoever; and that said
land is free of all encumbrances, except taxes accruing subsequent ~
to December 31, 1974.
This conveyance is subject to the following restrictions, con-
ditions, covenants and reservations which are specifically i.mposed
on the land conveyed above. ;

1. The real property conveyed herein shall be used exclusively
for the construction of residential dwelling and ancillary facilities,
provided that should the grantee sell or otherwise convey the subject ;

, property, it shall then be used exlusively for marine research,
scientific and educational purposes and shall not be used for a com-
~ mercial shipyard, provided always that the grantee may use the prop-

i erty for repair, renovation, alteration or maintenance of vessels, , ;

' vehicles or equipment, used in or related to the operation of marine ;

i research, scientific and educational activities. ~

r 2. No building shall be constructed nearer than 10 feet to the ~

~ bulkhead line of the channel situate on the property herein conveyed.

a 4. Grantee shall not erect buildings or other appurtenances

- on more than 50~ of the available drY land situate on the premises

S. Th,e grantee, his heirs or assigns, at his sole expense

good maintenance and repair. ~
