10. In the event Lessee is unable to obtairi all permits and permissions necessary to install. operate and '
maintain on the leased premises the necessary bnitdings and equipment for conducting its business as herein ;
pravided, or if at any time hereafter Lessee is prevented by operation of lav~ from using said atation and ~
pnmises for the purposes aforesaid~ then and in any of said eventa Lessee may. st its option. cancel this
lease and be relieved of any further liability hereunder. ~
11. At any time. or from time to time. or on the termination of this lease by lapse of time or otherwise. ~
Lessee may~ at its option and at its own expense, remove from the demised premises any part of or all the ~
improvements and equipment of whatscever nature heretofore or hereafter placed or owned by it on the
demised premises. whether aft~xed to the premises or located :u. on or under the same~ or not; and after such ~
removal shall restore the surface of the ground to its uniform level and even condition, free from all excava-
tiops and debris.

S 13. PURCHASE REFUSAL OPTION. If at any time during the primary term any extension period ~
~ or any tenancy after either, Leasor recei~es from a ready, willing and able purchaser~ an acceptable bona ~
~ fide offer to purchase, or makes a bona fide offer to sell to such purchaser~ the premises or any part there- ;
4 of or any property which includes all or any part of the premises : Le.ssor shall give Lessee notice, specifying ~
~ the name and address of the purchaser and the price and terms of the offer~ accompanied by Lessor's affida- ~
~ vit that the proposed sale is in good faith. Lessee shall thereupon have the prior option to parehase the
premises or the part thereof or the entire property covered by such offer, at the price and on the terms of
~ the offer but subject to the terms provided in article 12, which option Lessee may exercise by giving I.essor ~
~ notice within thirty (30) days after Lessee's receipt of Lessor's notice of the offer.

14. ~il notices gi~~en under this instrument shall be in ~riting, and may be gi~•en either in the statutory
- method, if any, in the State where the premises are situated, or by depositing the notice in the Unit~d States
registered or certified mail. postage prepaid, enclosed in an envelope addressed to the party to be notified, at
~uch party's address as shown in this instrument, or at any known address of any Lessor, if there be more
_ than one; and the day upon which such notice is so mailed shall Ue treated as the date of service. Such notice
- also may be served on Lessor in person or on an officer or manager of Lessee. If there Ue more than one
; Lessor, notice to an}• one of them shall constitute notice to all, and notice from any one of them shall
constitute notice from all.
~ 15. THIS AGREEMENT shall be binding upon and inure to the benefit of Lessor and Lessee and as weli
the grantees, heirs. executors, administrators. successors and assigns of Lessor. and the successors and assigns ~
~ of Lessee. Lessee shall have the right to assign this lease or sublet the premises or any part thereof. or al~G?
{ third parties to occupy and use the same. This agreement constitutes a merger of all proposals, negotiat~ons -i
~ and representations with reference to the subject matter and provisions hereof. and maS• be altered. amended ~
' or modified only in writing signed by Lessor and a representative of Lessee authorized to sign this agreement. ~

~ or managers and that none other has authority to consent or agree to any alteration, amendment. modification ~
~ or limitation whatscever of the terms of this agreement.
