Said conveyance to be from Margret Prappas, the unremarried
survivinq widow of Paul Prappas, deceased, as grantor, to Steph~n

Nikitas as grantee. ;
3. Plaintiff shall concurrently with the execution and ~

delivery of the aforesaid k•arranty deed by the defendant Margret ~
Prapgas deliver to said defendant his duly executed note with
documentary stamps affixed as required by law in the amount of
$35,000.00, payable according to the terms set forth in the deposit
receipt agreement between said parties and plaintiff shall con- I

aurrently with therewith deliver to said defendant a duly executed
purchase money mortgage securing payment of said promi.ssory note
and encumbering the property described in Paragraph 2 above;
said mortgage to be in usual form; further, at the time of delivery
of the aforesaid warranty deed and promissory note and purchase
money mortgage, the plaintiff shall pay to said defendant the E
balance of the down payment according to the terms of the deposit

receipt agreement, said balance to be in the sum of $9,000.00, ~
less the defendant Margret Prappas' pro rata portion of taxes

on the subject property for the year 1975, said pro ration of !
taxes to be based upon taxes for the year 1974 without discount.

; 4. All parties are directed to exchange the instruments

~ and make the payments provided in Paragraphs 2 and 3 above

( concurrently on or before June l, 1975, at a time and place to

~ be agreed upon by couns~l for the parties.. -

~ 5. The plaintiff shall have and recover from the defendant
~ his costs expended in this cause, the amount thereof to be taxed
~
~
~ by the subsequent order of this Court.

~ 6. The Court retains jurisdiction of this cause and the
parties hereto for the enforcement of this judgment.
