THIS EASEMENT, made this /3 ~day of ~ , 1975, :
between INDIAN RIVER COMMUNITY COLLEGE DISTRICT BOA OF TRUSTEES,
Grantor, and FORT PIERCE UTILITIES AUTHORITY, whose post office
address is P. O. Box 3191, Fort Pierce, Florida 33450, Grantee:

WITNESSETH: That Grantor, in consideration of the sum
of $10.00, and other valuable considerations, paid, receipt of '3
which is hereby acknowledged, hereby grants unto Grantee, its
successors and assigns, an easement and right of way for the
installation, maintenance and operation of a gas line in, upon, .
under and through the followinq described land in St. Lucie . j
County, Florida, to wit:

of Virginia Avenue and the West right of way of '
South 38th Street, run South al.ong the West
right of way of South 30th Street a distance of
914.2 feet to the point of beginning of the
centerline of a 10-foot wide easement described

From the point of beginning, run North 87° ~
27' West a distance of 563.4 feet to the
t~:rmination of the centerline of the 18-foot
wide easement;

all located in Section 20, Tvwnship 35 South, ~
Range 40 East, St. Lucie County, Florida.
BV accentance of this Easement. Grantee cnvc~nantc that
the installation, operation, service and maintenance of said
gas line crossing said easement are to be at Grantee's sole
expense and will be accomplished in a manner not adversely
~ affecting the use of Grantor's remaining property. Grantee
; further covenants that by the acceptance of this Easement,
~ Grantee will save harmless and indemnify Grantor against ' ~
; damages (including but not limited to damages to property of ?
~ Grantor), costs and charges imposed on or demandab le from
€ Grantor as well as any and all suits, transactions, judgments f
~ and executions that may or shall at any time arise from or be ;
~ brought against Grantor by reason of loss of life or injury to
person or property resulting from the construction, operation,
maintenance or use of said easement. Grantee, by the acceptance ~
of this Easement, furtYier covenants that after said gas line is y
~ installed and after each subsequent repair and alteration, the ~
property described in this Easement will be restored as nearly ~
~ as possible to the condition existing before the installation
~ repair or alteration at the expense of Grantee. Grantee by
~ acceptance of this Easement further covenants that the Grantor '
~ shall have the right to use the land subject to the Easement
~ for any purposes not inconsistent with the rights qranted herein
- to Grantee.

~ TO HAVE AND TO HOLD the same unto the Grantee, its suc-
- _ cessors and assigns forever.
