defendants filed by Rupert Jason Smith, Esquire, is hereby
granted and he is permitted to withdraw as attorney of
record for the defendants herein; further, the said Rupert
Jason Smith is hereby granted leave to intervene as a party
defendant herein with leave to file an answer within ten ~
(10) days of the date hereof.

4. Plaintiff's motion to strike the affirmative defenses ~
of the defendant Kavanaugh, by consent of both parties, is
granted as to paragraph l; as to paragraph 2 of said defendant's
affirmative defenses, said motion is denied.
