HomeMy WebLinkAbout2144 . ~ REC~IPT, ACK:70~~LCDG:•iCNT, ASSUt1PTI01~ At~D ACCI:PTAVC~ 3Y PURClIASL•'R ~ Purchaser, by acceptance and execution of this Receipt, acknowlcdges that this purchase of a condominium unit at OCEAN VILLIIG~ OF IIUTCHINSON ISLA:dD is subject in every rc:spect to the Declaration of Condominiu:n as to the condominium in which t~is unit is located and ~xhibits attached thereto, including Lu~ not limited to (whether thc same are attached to the Declaration or referred to therein), the By-La~vs of the Association, Articles of Incorporation, the Rules and Regulations, copy of projected operating budget, copy of sales brochure and f loor plan of apartment purchased by Purchaser, and all Amendments to the aforesaid Declaration and Exhibits and the Articles of Incorporation, By-Laws and Declaration of Covenants and Restrictions of the Pro~erty Owners' Association; and Purchaser further acknowledges reccipt of and reading and examination of said Declaration, its Exr.ibits, and budget, sales brochure and floor plan, and acknowledges that each and every provision of the foregoing is essential to the successful operation and management of tne Condo- minium property and is in the best interests and for the benef it of all the owners therein. Purchaser and all owners of parcels in the aforedescribed Condominium covenant and agree to abide by each and every provision of said Declaration of Condominium and Exhibits attached thereto. Purchaser hereby ratifies and confirms and approves all of the terms and provisions of said Declaration of Condominium and E~;hibits attached thereto, and agrees that the assessment under the Property Owners' Association documents referred to above and the - provisions thereof are reasonable, fair and equitable, and said Pur- chaser acknowledges and confirms that the Declaration of Covenants and Restrictions of the Property O~,mers' Association has encumbered and ir.?pressed a lien upon the Condominium parcel being conveyed to Purchaser, as security for his obligations under the said Declara- tion of Cavenants and Restrictions of the Property Owners' Associa- tion and said Purchaser assumes the obligations as to the Property Owners' Association as to his condominium parcel. Purchaser confirt~s that all warranties, representations and inducements if any, are as contained in the aforesaid Declaration of Condominium and E.chibits attached thereto, and the common expenses and the sums due under the ; Property Owners' Association and other charges are estiriated only. ~ No warranty or guaranty is made or intended, nor may one be relied ~ except where the same is specifically caarranted or guaranteed in t said Declaration of Condominium and the Exhibits attached thereto.
