RE: Sewer facility

Gentlemen:
As you are aware, Ivew Jersey Real~~ `rit3i ~yay8 Co~gany hol3s a
collateral mortgage given by Lucille V. Costa, et vir, and
recorded in Official Record Book 220 at page 2870 and re-
recorded in Official Record Book 221 at page 1149 of the
public records of St. Lucie County, Florida. This mortgage
encumbers approxi.mately 70 acres of land on North A-1-A in St.
Lucie County, Florida, as more particularly described therein_
At the time of delivery and recordation of the mortgage, an
operational package sewer plant facility, which was then and
is now presently owned by Costa Development Corporation, was

~ For consideration received this date, New Jersey Realty Mort-
~ gage Company hereby confirms and recognizes the prior rights
~ of Costa Development Corporation to operate the aforementioned
E package sewer facility and the right of La Sagra Condominium
~ and other users presently served by said facility to continue
to receive such service. In the event New Jersey Realty Mort-
~ gage Company should ever foreclose the aforesaid collateral
F ~uortgage, it hereby agrees for itself and its successors and
~ assigns not to disturb the continued operation of said sewer
~ facility and its service to the areas for which it was designed
= to serve, includinq the La Sagra Condominium.

~ ~Tew Jersey Realty Mortgage Company further recognizes the righ~
~ of Costa Development Corporation to enter into contracts in the
- future to provide sanitary sewer service to users in the area
F for which the facility was designed to serve and will provide
such further assurance as you may reasonably require concerning
: the subject matter of this letter.
