SPECIAL WARI~ANTY DEED
THIS INDENTURE, made this ~''""day of , 1975, by
FLORIDA EAST COAST RAILWAY COMPANY, a Flori c ration, with
its address being Post Office Drawer 1048, t. Au stine, Florida
32084, hereinafter called "Grantorp, to DOUGLAS H. KERR and JOAN
KERR, his wife, of 3490 Oleander Avenue, Ft. Pierce, Florida
33450, hereinafter called "Grantees".
WITNESSETH:
That Grantor, for and in consideration of the swn of Ten
Dollars ($10.00) to it in hand paid by said Grantees, the receipt
whereof is hereby acknowledged, has granted, bargained and sold
to Grantees, their heirs and assigns forever, the following
described land in St. Lucie County, Florida, to-wit:
A parcel of land lying in the northwest one-quarter of
_ Section 31, Township 35 South, Range 40 East, St. Lucie
County, Florida, and beinq more particularly described

of 356.18 feet to the point of curvature of a curve to

will defend same against the lawful claims of all persons claiming

not otherwise.
~ SUBJECT TO covenants, restrictions and agreements as follows:
~ Grantees agree, for themselves and their heirs and assigns,
~ unto and with Grantor, its successors and assigns, as a covenant
running with the land for a period of 30 months from the date of
i _ this conveyance, and as a part of the consideration for this
~ conveyance, said covenant being evidenced by the acceptance and
! recordation of this deed by Grantees, that said premises hereby

! conveyed will be utilized for and in connection with the con-
struction thereupon of a substantial warehouse building or
` structure having an area of not less than twenty thousand (20,000)
~ square feet, for use or to be used for the conduct of Grantees'
