HomeMy WebLinkAbout2159 State of Florida and said lien will carry interest at the rate of Eight (8%) per cent per annum from date of advance until paid, and in the euent it becomes necessary to foreclose aaid lien, the party or parties so fore- clo~ing the same shall be entitled to recover in the foreclosing proceed- inqs all Court costs and reasonable attorney fees incurred or expende~ in the foreclosure and collection~_of the amount due by such defaulting Beneficiary. TENTH: No party dealinq with the Trustees in relation to the Trust property in any manner whatsoever, and (without limiting the foregoing~ no party to whom said property or any part thereof or any interest therein shall be conveyed, contracted to be_sold, leased or mortgaged by the Trus- tees, shall be obliged (a) to see to the application of any purchase money, rent, or money borrowed or otherwise advanced on said property, or (b) to see that the terms of this Trust Agreement have been complied with, or (c) to inquire inta the authority, necessity or expedience of any act of the Trustees, or (d) be privileqed to inquire into any of the terms of this Trust Agreement. Every deed, mortgage, lease or other instrument executed by the Trustees in relation to the Trust property shall be conclusive evidence in favor of every person claiming any right, title or interest thereun~er (a) that at the time of delivery thereof the Trust created hereunder was in full force and effect; (b) that such instrument was executed in accordance with the terms and conditions of this Agreement and all amendments hereof, if any, and is binding upon all Benefiaries i ' hereunder; (c) that the Trustees were duly authorized and empowered to i i • ~ execute and deliver every such instrument; (d) if a conveyance has been ~ F } ~ made to a successor or successors in Trust, that such successor or succes- ~ ~ ~ sors have been properly appointed and are fully vested with all the title, - ~ estate, rights, powers, duties and obligations of its, his or their pre-. ~ E decessor in trust. ~ ~ ELEVENTH: This Agreement may be placed on record in the County ; a ~ in which the Trust property is situated, or elsewhere, but if same is so # , € recorded, such recording 'shall not be considered as notice of the rights ~ ~ x ~ of any person hereunder derogatory to the title or powers of the Trustees. ~ "s ~ TWELFTH: No Beneficiary shall have the authority to contract for : € ~ or in the name of the Trustees or any other Beneficiary or to bind the ~ Trustees or any other Beneficiary personally. ~ ~ aornc~~ ~ ~ ~ a - ~ ~ ; ~ ~ - i~X,~~ _2Ssm 4 i",. ..SYa' ^-4 , s -^^4.
