within a reasonable time, the lessee shall have an option to take
~ the premises as is under the above terms as apecified or to elect
~ not to complete the purchase and shall have returned all moneys
paid under this lease and option excluding any rent which shall

VI. Each of the parties will bear the standard costs
in closinq a real estate transaction.

! this condition, that if the rent reserved or any part thereof

formally demanded or not, or if any covenant on the lessee's

cases it shall be lawful for the lessor to re-enter at any time
i~ thereafter upon the demised premises or~any part thereof in the
name of the whole, and thereupon this demise shall absolutely
3~ determine, but without prejudice to the riqht of action of the
t~ lessor in respect of any breach of the lessee's covenants herein

~y VIII. And provided, also, that in case the building ~

on the premises or any part thereof shall be damaged by fire or

j other avoidable casualty, so that the satne shall thereby be
~ rendered unfit for use and oc~upation, then and in such case the

rent hereby reserved or a just and proportional part thereof ~

according to the nature and extent of the injury sustained, ~
~
shall be abated until the premises shall have been duly repaired
~
~ and restored by the lessor, or, in case th~ said~premises shall ~

be substantially destroyed, then at the election of the lessor ~
(or, at the election of either the lessor or the lessee) the
estate hereby created may thereupon be detenained.
