ORDERED AND ADJUDGED that: '
l. The Motion to Dismiss is granted as to Count III of the
B.J.E. INDUSTRIES, INC. Complaint. - ~
2. That the Motion is denied as to the Cross-Claim and Counts
I and II of the Complaint.
3. The Plaintiff shall have 20 days from this date in which to
file any amended pleadings as to Count III.
4. The Defendant, GENERAL DEVELOPMENT CORPORATION, shall have
10 days from the date of filing of any amended pleadings, if any, or
from the expiration of 20 days or from filing of a notice that no
amendment will be filed as to Count III in which to file appropriate
pleadings in response to the Cross-Clai.m and the Complaint of B.J.E.
